Lawsuit Filed Against Palmetto Palms, FirstService Residential, and Florida Power & Light (FPL) for Negligence Resulting in Catastrophic Injuries
Tampa, FL – May 2, 2025 – Black Rock Trial Lawyers today announced the filing of a lawsuit on behalf of their client, Donna Marie Schott, against Palmetto Palms RV Resort Condominium Association, Inc., FirstService Residential, Inc., and Florida Power & Light Company (FPL). The lawsuit, filed in the Circuit Court of the Twentieth Judicial Circuit in and for the County of Lee, Florida, seeks damages in excess of $50,000.00 for negligence resulting in catastrophic and permanent injuries sustained by Ms. Schott.
The complaint alleges that on or about March 26, 2024, Ms. Schott, a resident of Lee County, was operating an electric tricycle at Palmetto Palms, a property managed by FirstService. Due to the presence of a temporary speed bump, allegedly used by FPL to cover electric cables and similarly colored to the asphalt roadway, Ms. Schott was unable to distinguish the hazard. This resulted in the tricycle launching, causing Ms. Schott to hit her head and body on the asphalt.
The lawsuit claims that Palmetto Palms and FirstService Residential breached their duty of reasonable care to maintain a safe environment for residents by failing to properly inspect the property, identify known dangers, and ensure the premises were free of hazards. Furthermore, the suit alleges FPL was negligent in failing to ensure the temporary speed bump was visible to those traveling on the roadway.
As a result of the Defendants’ alleged negligence, Ms. Schott has sustained severe damages, including:
Bodily injury
Past, present, and future physical pain and suffering
Disability and inability and loss of capacity to lead and enjoy a normal life
Inconvenience
Physical impairment
Loss of or diminution of earnings or earning capacity
Permanent injury within a reasonable degree of medical probability
Medical and related expenses

The lawsuit seeks a trial by jury and judgment against Palmetto Palms RV Resort Condominium Association, Inc., FirstService Residential, Inc., and Florida Power & Light Company (FPL) for an amount exceeding $50,000.00, plus costs, and any other relief the Court deems just.
